I have a small issue with a software remote running on an airsync running wince 4.2. If I have the panel set to switch off in the config panel at say 70 %. When I try and switch the panel back on it just turns the panel back off again straight way . I have to recharge the panel to above the percentage in order to activate. I never had this issue prev. Could a delay be set in the activation of this?0

You might want to enable tracing on the SWRemote and see if the trace file shows anything helpful. There are a few sleep related messages that should get logged.
It's odd because if the unit is on AC Power (like when charging), it skips the battery level check altogether, and I don't think there were any changes in this area for V3.
